- How severe the injury is: Doctors give an “impairment rating” that measures how much permanent loss you’ve suffered.
- The part of the body injured: South Carolina law sets specific time limits (in weeks) for how long benefits can last, depending on the body part.
Back Injuries Under South Carolina Law
The law treats back injuries in a special way.
- If you lose less than 50% of the use of your back, the maximum number of weeks you can be paid for is 300 weeks. Your award is calculated by multiplying your impairment percentage by those 300 weeks.
- Example: If your doctor says you lost 25% of the use of your back, that’s 25% × 300 weeks = 75 weeks of benefits.
- If you lose 50% or more of the use of your back, the law presumes you are totally and permanently disabled. That means you may qualify for up to 500 weeks of benefits, unless the insurance company proves otherwise.
Neck Injuries Under South Carolina Law
Neck injuries are a little different because they don’t appear on the “schedule” the way arms, legs, or backs do. Instead, the Workers’ Compensation Commission looks at your whole-body impairment.
- The maximum for these kinds of injuries is 500 weeks, but your award depends on how much overall function you’ve lost.
- In some cases, if your neck injury causes permanent disfigurement that is visible (like scarring), you may be entitled to additional weeks of benefits.
